Mother, boyfriend accused of starving disabled son to death while using his benefits, police say

A New York mother and her boyfriend are accused of restraining, abusing and starving her developmentally disabled adult son to death while allegedly using his government benefits for themselves, according to Rochester police.

Andrea Livers, 58, and her boyfriend, Lancysa Harris, 42, were arrested Sept. 15 in connection with the death of Livers’ 33-year-old son, Timothy Green Jr. Both are charged with second-degree murder, first-degree kidnapping and endangering the welfare of an incompetent or physically disabled person.

At around 11 a.m. on Feb. 17, Green was found dead inside an apartment at Andrews Terrace, a multi-unit residential building at 125 St. Paul Street in downtown Rochester, after Livers and Harris called 911.

According to WXXI News, first responders found Green naked on the floor, severely emaciated and covered in bruises. He weighed just 88 pounds. Investigators searching the apartment found handcuffs, barbells and weights, along with what police described as an unusual amount of cleaning supplies.

Despite evidence that Green had been living in the apartment, investigators found no clothing, bedding or other personal belongings belonging to him, police said. Livers and Harris were reportedly uncooperative with investigators, providing information police described as “minimal and nonsensical.”

The Monroe County Medical Examiner’s Office ruled Green’s death a homicide in July, determining that he died from severe dehydration and failure to thrive in a setting of probable restraint. Police said evidence recovered from a cellphone also supported allegations that Green had been restrained.

Green had developmental disabilities but was physically capable of caring for himself, according to investigators. He required assistance with some of the more complex activities of daily living.

Green spent most of his life in Tuscaloosa, Alabama, where he lived with his father and stepmother. Police said his mother lost custody of Green when he was young because of abuse-related issues.

After his father died in 2023, Green moved to Rochester to reconnect with his biological mother. His stepmother, Marbrey Green, said she had helped raise Timothy since he was 3 years old and was known to his family as “Junior.” She described him as friendly and well known in his Alabama community.

Marbrey described Green as living in something of a dream world, often watching cartoons and talking about Greek mythology, reports WROC- TV.

Family members reportedly tried to discourage him from leaving Alabama following his father’s death, but Timothy ultimately went to Rochester with his biological mother.

Around June 2024, Harris became the designated payee for Green’s Social Security and Supplemental Nutrition Assistance Program (SNAP) benefits. Police said Green stopped attending medical and other appointments around the same time.

Green’s family later began having difficulty reaching him. Marbrey told 13WHAM that communication became difficult in September 2025. The family heard from him again in December, but she said they sensed something was wrong.

Investigators reviewed approximately 45 days of surveillance footage from the apartment building leading up to Green’s death. Police said the footage showed Livers and Harris entering and leaving the apartment, but Green was not seen leaving during that period.

Authorities allege Livers and Harris used Green’s SNAP benefits to purchase food for themselves while depriving him of adequate food and water. A separate federal investigation is underway into the use of Green’s Social Security and SNAP benefits, according to police.

Questions also remain about whether Green had previous contact with Adult Protective Services. Rochester Police Capt. Frank Umbrino said he did not know whether APS had been investigating Green. A Monroe County spokesperson told WXXI the county was reviewing its records.

Livers and Harris were arrested on sealed indictment warrants Sept. 15. The indictment was subsequently unsealed. Both are being held in the Monroe County Jail without bail and are scheduled to return to court later this month.
