Marshall County District Attorney Jennifer Bray announced Thursday afternoon that a jury found John Bannan, 56, guilty of aggravated cruelty to animals in the brutal killing of an elderly Australian shepherd named Jack.
According to the Marshall County Sheriff’s Office, Bannan was booked on an aggravated cruelty to animals charge on Oct. 12, 2023. He was 53 at the time and was released shortly after midnight the following morning.

Jack wasn’t Bannan’s dog. He was a beloved neighborhood pet who, according to testimony, had never before wandered away from his own yard.
Bray said the evidence showed that when Jack ended up on Bannan’s property, Bannan called the elderly dog toward him. When Jack came to him, Bannan grabbed him by the fur, violently slammed him onto the pavement and beat him.
The attack was captured on video.
But Jack’s suffering didn’t end there. Prosecutors said Bannan then shot the dog, disposed of his body and later lied to investigators about the last time he had seen him.
Bannan took the stand at his trial and admitted what he had done, Bray said. He argued, however, that his actions were justified because Jack had come onto his property.
“Testimony, including from Bannan himself, established that Jack was a well-loved dog who had never previously gotten out of his yard and posed no threat to Bannan, his livestock, or anyone else when Bannan chose to brutally kill him,” Bray wrote on Facebook.
Bray said Bannan had other choices, simple ones that would have allowed Jack to go home to the people who loved him.
“Mr. Bannan had any number of reasonable options available to him. He could have taken Jack home, called a neighbor, or simply let him go,” she said.
“What he could not do was torture and kill a harmless dog simply because that dog wandered onto his property.”
Bray said Assistant District Attorney Adam Culbert put the issue plainly for jurors during closing arguments: Alabama law is not “Bannan law.”
In other words, Bray explained, “you cannot simply torture or kill a dog because it comes onto your property.”
Bannan will be sentenced at a later date.
